TERMS AND CONDITIONS – JapanAuc

Here are the terms and conditions provided by JapanAuc relating to the provision of an auction buying and export service. By using www.japanauc.com, you agree to the following terms and conditions. If you disagree with these terms and conditions, then please stop all dealing with JapanAuc and refrain from accessing www.japanauc.com.

Definitions

“WE”, “SELLER”, and “JapanAuc”, refer to JapanAuc and any of its associated suppliers, business partners, or agents.

“YOU”, “CUSTOMER” or “BUYER” refers to a person or company that has entered into an agreement to use the JapanAuc auction, stock-buying, and export services.

“CAR”, “VEHICLE”, “UNIT” or “ITEM” refers to the article of purchase.

“AUCTION”, refers to the Japanese used car auctions, Yahoo auction, other one-price platform or similar where JapanAuc will bid for customers.

“BID”, “BIDDING” refers to the action of JapanAuc in trying to secure a car for a customer.

“BUDGET” refers to the maximum amount that the customer has predetermined they want to pay for the car or item at auction.

“Purchase” refers to JapanAuc procuring a vehicle or item on behalf of a customer.

“DEPOSIT” is a pre-agreed amount that a customer deposits with JapanAuc to enable the purchase of a vehicle or item.

“SALE” is a transaction between a customer and JapanAuc to buy and export a vehicle or item.

“INVOICE” refers to the document produced by JapanAuc that shows the amount due for a completed service. “AS IS” is a term used to describe the condition of a car or item, disclaiming any implied warranty. The buyer accepts the item in its current condition, with all faults, whether or not they are immediately apparent.

FINANCIAL CONDITIONS

1. Deposit: Prior to bidding, the customer must deposit a minimum of 150,000 JPY to JapanAuc. This deposit will be deducted from the total amount due on the customer’s invoice. Failure to pay the invoice will result in the deposit being used to cover losses pertaining to the unpaid invoice. Deposits can be refunded at any time before JapanAuc purchases a vehicle or item for a customer, minus any bank or transfer fees. If work has been done, a service charge may be deducted from the refund. Deposit amounts for expensive or unusual items will be negotiated between the customer and JapanAuc.

2. Payments: Full payment must be made via bank transfer within 48 hours of invoice receipt. Failure to do so may result in additional late fees.

3. Exchange Rates, PayPal Rates, and Bank Charges: JapanAuc is not responsible for the exchange rates used by banks, money transfer companies, PayPal, or similar. All bank fees are the customer’s responsibility.

BIDDING

1. JapanAuc agrees to bid up to the predetermined amount set by the customer for a specified item, but reserves the right to overbid by up to JPY 20,000 if necessary to win the auction.

2. If a car or unit is unsold at auction, JapanAuc will automatically negotiate to buy the item up to the customers budget if necessary, unless otherwise specified.

3. In the case of multiple bidders on the same car: Sometimes, more than one party will bid on the same car. In this situation, the party with the higher bid wins the car, regardless of the other party’s bid amount. For example, if Party A has a maximum bid of Y1,300,000 and Party B has a maximum bid of Y1,000,000, and the car sells at auction for Y900,000, Party A will win the car and pay Y900,000. We do not discuss other customers’ bid amounts.

CANCELLATION

Once a vehicle or item has been purchased by JapanAuc for a customer, the purchase cannot be cancelled. Failure to pay an invoice in full will result in a loss of deposit.

SERVICE AND RESPONSIBILITY

JapanAuc is an auction agent, buying service, and export company. We do not own the cars or the auction houses, nor do we have any influence over how they operate. JapanAuc is not responsible for incorrect information on auction condition sheets, misrepresented cars, or the actions of any agents working for JapanAuc, including transport companies, courier companies, shipping lines, insurance companies, dealerships, and port yards. JapanAuc will provide all available information, but is not responsible for incorrect translations or assumptions made by customers based on such information.

VEHICLE CONDITIONS

JapanAuc is not responsible for the condition of cars before or after purchase. While we will take care to provide customers with as much accurate information as possible, ultimately, it is the customer’s decision whether to bid on or purchase a vehicle. All cars are purchased as is, and we take great care in transporting, storing, and shipping vehicles and items. JapanAuc is simply an agent that assists with the purchase and export process. JapanAuc is not responsible or liable for the actual condition of the vehicle or item or for possible damage incurred during shipping or storage.

IMPORT REGULATIONS

It is the customers’ responsibility to ensure the vehicle or item meets their local rules and regulations. While JapanAuc can provide advice on such matters, it is ultimately the customer’s responsibility to ensure the vehicle or item is eligible for import into the destination country.

COPYRIGHT

All content on www.japanauc.com is the property of JapanAuc or the respective owners and is protected by international copyright laws.

GOVERNING LAW

Any dispute arising from or pertaining to this agreement between a customer and JapanAuc fall under the jurisdiction of the Tokyo District Court and are subject to the relevant Japanese law.

CHANGES TO THIS AGREEMENT

JapanAuc reserves the right to amend these terms and conditions at any anytime. Your decision to continue to visit and make use of www.japanauc.com and JapanAuc after such changes have been made constitutes your formal acceptance of the new Terms and Conditions.
